Rights Alliance guides educational institutions on the legal restrictions on the use of chatbots

After finding that textbooks are being uploaded to generative AI tools without the necessary permission from the publisher, RettighedsAlliancen publishes a guide on the legal restrictions on the use of chatbots at educational institutions.

There has been an urgent need to raise awareness of the legal restrictions on the use of chatbots, such as ChatGPT, by institutions, teachers and students at Danish educational institutions. Therefore, the Rights Alliance is now publishing a guide that reviews the rules for the correct use of chatbots in educational contexts, based on our experience with protecting copyright material and current legislation.

Need for clarity around rules

With the rise of ChatGPT and other chatbots, new ways in which protected works, including textbooks, can be misused have emerged. When users upload digital copies of textbooks to ChatGPT and other chatbots, the works are processed to enable the chatbot to, among other things, answer questions about the content or generate text that is similar or identical to the uploaded material. This is illegal unless the relevant rights holders have given explicit permission for the work to be uploaded to generative AI tools.
